Administrative service procedures :
  • dates • Step 1. Registering in EKTIS and obtaining farmer status
  • Any natural or legal person who wants to produce agricultural products and owns a farm or land can register in EKTIS and get the status of a farmer. Electronically directly (through the website www.eagro.az) or at the service location, a land document (in case the data cannot be integrated through the Electronic Government Information System (hereinafter - EHIS), the original of the land document may be required), ID card and mobile phone is registered at EKTIS within 5-10 minutes. During on-site registration, the farmer signs an application for registration in the EHIS.
  • Step 2. Land plot registration
  • The farmer enters the following information about land plots or, if there is a change in the entered information, into EKTIS:
  • • information on the area where the plot of land is located (district (city), village (town));
  • • details of the land document (code, JN, registry number, registration number, etc.);
  • • if the land document is a state act or certificate, then the number of each contour, its area, category and information on its purpose;
  • • documents confirming the features of the land area (target designation of the land, valuation) and the farmer's right to use it (state acts on the right to land ownership, ownership, permanent use, certificate on the right to temporary use of land, extracts from the state register of real estate, purchase approved by a notary sale, lease and sublease contracts with a term of less than eleven months, as well as the area approved by the executive representative in accordance with the Instruction "On the rules for conducting notarial actions in the Republic of Azerbaijan" approved by the Resolution No. 167 of the Cabinet of Ministers of the Republic of Azerbaijan dated September 11, 2000 agreements on the lease and use of non-many agricultural plots of land for a period not exceeding one year, inheritance certificates, documents related to plots of land given to internally displaced persons, in unreformed regions (with areas close to the front line (r) copies of documents that are the basis for the conditional division of land plots, allotment of land that is not a state act;
  • • References to agrochemical analyzes in accordance with the decision of the Agrarian Subsidy Council.
  • The land plots and information entered into EKTIS by the farmer in the relevant region are approved by DAIM.
  • Note 1. If the documents confirming the farmer's right to use cannot be obtained through integration from the Service's Electronic Services Portal, the farmer must submit the original (certified copy) of those documents or the relevant reference received from the Service.
  • No additional document is required if the document confirming the right of use of the farmer contains the characteristics of the land (target designation of the land, assessment) or if this information is obtained from the Electronic Services Portal of the Service through integration. If this information is not in that document or if it is not available through that system, a reference from the state register of real estate obtained from the Service is required.
Note 2. The results of agrochemical analysis are later included in EKTIS together with the acts showing the monitoring results. Agrarian Services Agency under the Ministry of Agriculture of the Republic of Azerbaijan checks the status of inclusion of analysis results in EKTIS and regularly informs AKIA about it.
Criteria for granting planting subsidy:
* Planting subsidy (given to the first declared plant for each year) - that the intended purpose of the land is planting, perennial planting and resting;
* Subsidy for replanting (second planting in the same place after harvesting the first crop during the year and
given to the plant declared in EKTIS) - that the intended purpose of the land is to be cultivated, rested and
Declaration of the first planted plant in EKTIS;
* One-time planting subsidy (given to gardens planted on plants determined by the decision of the Agrarian Subsidy Council in the year of application) - the purpose of the land is for planting, perennial planting and fallow, in addition, it is vacant land of the forest fund, it is mountainous at an altitude of 200-1500 m above sea level and foothills soil (for hazelnuts only), moderately salinized, severely salinized, very severely salinized, saline, moderately salinized, severely salinized, or a bonity score below 40 (for pomegranates and olives only), above sea level the presence of mountainous and foothill land at an altitude of at least 400 m (for grapevines only). In the documents of the land with a credit score below 40, the purpose designations are "cultivated", "set aside", "multiple planting", "other", "etc." can be written or that section can be left blank;
* Planting subsidy is calculated on the basis of the areas of cultivated land according to the document and drawn on the map. The area of ​​the land (parcel) drawn on the map-scheme cannot exceed its area according to the document. If the actual planted land area is more than the area according to the document, the subsidy is calculated based on the area according to the document. The farmer can apply to the Service for making appropriate amendments to the land documents to formalize the right to use the area;
* If planting is done on the land whose purpose is pasture, summer-winter pasture, mowing, the planting subsidy is not calculated for that area. In this case, up to 3 percent of the total land area planted for green fodder is considered legally used. In such areas, a farmer who declares planting can be notified by SMS or e-mail about the refusal of subsidy payment. Thus, a fine is provided for in Article 247 of the Code of Administrative Offenses of the Republic of Azerbaijan for using the land for other purposes that are not in accordance with its intended purpose;
* Intensive gardens - must be planted starting from 2019 on the plants specified in the decision of the Agrarian Subsidy Council and must meet other requirements specified in that decision;
* In the decision of the Agrarian Subsidy Council, the minimum number of seedlings planted per hectare must be equal to 90 for other orchards that do not meet the requirements for intensive orchards.
Step 3. Declaration of planting and harvest forecasts on land plots, information on collected harvest
During the planting declaration periods, information about the previous year's harvest and 4-year forecasts (planned about the plant to be planted and the harvest to be obtained) is entered into EKTIS. Each year, on the dates indicated, the forecast for the remaining 3 years should be refined and the forecast for the last (4th) year should be added.
Step 4. Declaration of actual crops on land plots
The crops actually planted by the farmer in that year, from September 1 to the last working day of December for autumn crops, from February 1 to May 31 for spring crops, from June 1 to August 31 for repeated crops. and information about cultivated hectares is entered into EKTIS directly electronically or by visiting the service place. Newly planted and existing perennial crops (orchards and other perennial crops) are declared annually during the fall or spring planting declaration periods. Continuation of cultivation of existing plant species, as well as replacement with new plant species, must be declared annually.
The specification of the farmer's planting on the plot of land (parcel) is carried out through graphic vectorization (drawing) of planting declarations. The farmer verifies the map-scheme based on the actual coordinates according to the type of cultivation on the cadastral parcel of his land plot. Approved areas
The map scheme is considered the basis for satellite monitoring.
The forecast and the declared plant species in the land area can be changed during the specified period until the subsidy application is sent. The information formed on the area of ​​the declared plants is placed in the farmer's electronic cabinet for review and application. A farmer applies for a subsidy by pressing the "apply" button. After entering the declaration, the farmer who clicks the "apply" button has no possibility to change the declaration.
Step 5. Subsidy calculation
EKTIS automatically prepares the subsidy application according to the land plot (parcel) selected by the farmer, the plants planted there and the region. By January 15 of each year at the latest, the list of regions for subsidized plants and the planting coefficients of plants for those regions approved by the Agrarian Subsidy Council are included in EKTIS.
EKTIS calculates the amount of planting subsidy to be paid to the farmer based on the following formula, taking into account the results of the monitoring of the declared and applied crops at the end of the period:
Calculation of planting subsidy = 200 AZN (Base amount) × Planting coefficient of the plant in the region × 1.1 (If it is a cooperative that has cultivated or planted perennial crops on more than 50 hectares of land) × hectare of planted area
200 manat (base amount) x replanting coefficient = planting subsidy (on declared replanting)
200 manat (base amount) x one-time planting coefficient = planting subsidy (for new perennial planting that year)
Subsidy is not calculated for the land area (parcel) in one calendar year in excess of its subsidized portion (except for replantings decided by the Agrarian Subsidy Council).
EKTIS does not pay subsidies to farmers who do not press the "apply" button. A notification about this can be sent to the farmer near the end of the period.
Step 6. Monitoring of farmers' applications
Monitoring is carried out in the following manner according to the requests made by the farmer:
• cross-matching of electronic declaration data with other data in the system;
• ground observation - identification of crops and perennial plantings with satellite and other technical capabilities and matching with electronic declaration data;
• on-site observation - implementation of control and evaluation measures by DAIM specialists in places where crops are planted by selective method.
The information entered in EKTIS is compared with other relevant information available in the system. With this tool, the possibility of more than one declaration for the same plot of land (except for the case of cultivation of different plants on one plot of land), the possibility of declaration by multiple users with the same land document, the possibility of declaration of more than the size of the plot of land, the possibility of declaration outside the declaration periods, etc. case by case restrictions apply.
A certain part of applications is monitored on the basis of satellite maps (media images) covering the period of plant cultivation (plowing, planting), and evaluated on the basis of photo interpretation. As a result of satellite monitoring, the places suspected of not being planted are observed on the spot.
At the same time, EKTIS conducts a selection based on pre-defined risk criteria and sends a part of the applications for on-site observation.
The owners of applications selected for on-site observation (farmers) are informed in advance by DAIM employees about the time of observation. If the farmer refuses to participate or does not come to the place of observation at the specified time, the observation is carried out without the participation of the farmer and the result is recorded. When the farmer participates in the observation, the act is also signed by him. If the farmer refuses to sign, it is noted in the act. If the plant declared to be planted in EKTIS is not observed on the site or if another plant is observed on the site, as well as if it is determined that the conditions established for intensive gardens in step 2 are not met or the year of planting the garden is incorrectly declared, the result is 0.
If the difference between the declared planting and the planting determined as a result of monitoring does not exceed 5 percent, this difference is reflected in the monitoring act and the subsidy amount is reduced by the size of that difference.
If there is a difference of up to 20 percent between the declared planting and the planting determined as a result of monitoring, this difference is reflected in the monitoring act, and the subsidy amount calculated according to the monitoring result is paid by reducing it by 30 percent.
If there is a 20-50 percent difference between the declared planting and the planting determined as a result of monitoring, this difference is reflected in the monitoring act and the calculated subsidy is reset, that is, the subsidy is not paid to the farmer for that year.
If there is a difference of more than 50 percent between the declared planting and the planting determined as a result of monitoring, this difference is reflected in the monitoring act, the calculated subsidy is reset, and the subsidy for the area subject to monitoring is not calculated for that farmer during the current year and the following year.
Some declared crops are included in individual monitoring based on complaints or information received by the Ministry. In this case, the rules of on-site observation are applied.
Step 7. Approval of applications
Applications not selected for monitoring are automatically approved and sent to AKIA for payment.
If, as a result of monitoring, cases different from those indicated in the farmer's declaration are not identified, the relevant application is approved and sent to AKIA for payment.
If, as a result of monitoring, cases different from those stated in the farmer's declaration are determined, the above-mentioned monitoring acts are reflected in the farmer's office in EKTIS and a notification is sent to the farmer through EKTIS. After the monitoring act is submitted, if the farmer comes to EKTIS or DAIM and confirms the result, or does not object to the notification/monitoring result within 15 days, the requirements according to step 6 are applied to him. Objection to the notice with the participation of the farmer or AKIA
It is evaluated by a specialist of DAIM by conducting an on-site observation, and the result is recorded and entered into EKTIS.
The appeals of farmers who have complained about the results of monitoring are approved after the end of the investigation, the planting subsidy is calculated according to the results of monitoring and sent to AKIA for payment.
Step 8. Payment of subsidies
Applications calculated automatically by AKIA according to monitoring results or without monitoring are accepted in groups every month. Once the applications are accepted, they go into "ready for payment" status.
After the applications for the planting subsidy change to the status of "ready for payment", AKIA sends payment orders to the authorized bank and the subsidies are paid to the farmer's cards.
In the "Subsidies" section of the farmer's electronic cabinet, the amount of subsidies paid to him is reflected, and a notification about this is sent to the farmer in EKTIS.
Subsidy funds incorrectly paid to the farmer are returned to AKIA according to paragraph 5.5 of the Regulation, if this is not possible, the next subsidy funds are reduced by the already paid amount.
Article 411-2 of the Code of Administrative Offenses shall be applied if it is determined that the farmer has entered incorrect information in EKTIS after the subsidy payment has been made. If the farmer violates the subsidy rules and commits such an action for the first time, the farmer is warned if the wrongly paid funds are voluntarily returned by him. If the wrongly paid funds are not voluntarily returned by the farmer who committed such an action for the first time, as well as if the farmer commits such actions for the second time, a fine in the amount of 2 times the amount of the damage (earned income) caused by the administrative error in the case of natural persons and 3 times in the case of legal entities shall be imposed. is done. If such actions are committed in the 3rd or more cases, a fine of 4 times the amount of the damage (earned income) is applied to the farmers (individuals and legal entities).
If the subsidy funds given to the farmer are not used within 2 (two) years, a notification is sent to him via SMS and e-mail. If the farmer does not use the subsidy funds within 3 (three) months after the notification is sent, the subsidy will not be paid to him for the next year.
The amount allocated from the budget during the calendar year, which cannot be paid to the farmer by AKIA, is returned to the budget.
Step 9. Expenditure of subsidies
AKIA will pay the amount of subsidy on applications with the status of "ready to pay" from February
starting from February-March, it is transferred to farmers' accounts, and information about this is delivered to farmers via SMS.
The farmer begins to purchase production tools (fertilizers, seeds, pesticides), carry out agrochemical analysis of soils, purchase and build modern irrigation systems and poles for perennial plantings using the planting subsidy. Entrepreneurs who sell production equipment, as well as modern irrigation systems and poles, are registered as suppliers in EKTIS. Information about them (name, place, place of sale, etc.) is provided to the farmer through EKTIS.
The farmer can spend 25 percent of the subsidy amount in cash for his activities related to the field, and 75 percent for the purchase of agricultural production tools for planting, conducting agrochemical analysis of the soil, purchase and construction of modern irrigation systems and poles for perennial plantings through the farmer card. . 75 percent of the subsidy amount cannot be cashed and its use for other purposes is prohibited. This amount, which is transferred to the farmer's account, is used to pay for the cost of the production equipment, modern irrigation systems and poles sold by the supplier through the subsidy through the card. Thus, by passing the farmer's card through special pay points, the funds allocated to the farmer in this direction are entered into the supplier's account, information about the purchase and sale (production equipment sold and purchased, modern irrigation systems and poles, their quantity, the name of the farmer to whom it was sold, etc.) and the supplier's receipt is entered into EKTIS by
Article 411-2 of the Code of Administrative Offenses shall be applied if it is determined that the farmer does not use the subsidy for its purpose in violation of the Rule. If the farmer violates the subsidy rules and commits such an action for the first time, the farmer is warned if the wrongly paid funds are voluntarily returned by him. If the wrongly paid funds are not voluntarily returned by the farmer who committed such an action for the first time, as well as if the farmer commits such actions for the second time, a fine in the amount of 2 times the amount of the damage (earned income) caused by the administrative error in the case of natural persons and 3 times in the case of legal entities shall be imposed. is done.
